I quins riscos legals o reputacionals impliquen?<\/p>\n<p>En aquest article abordem qu\u00e8 s\u00f3n els claims, com es regulen en cosm\u00e8tica, alimentaci\u00f3 i deterg\u00e8ncia, i com Admixtio pot ajudar-te a construir un <strong>discurs t\u00e8cnic, s\u00f2lid i diferenciador.<\/strong><\/p>\n<h3><strong>Qu\u00e8 \u00e9s un claim?<\/strong><\/h3>\n<p>Un <em>claim<\/em> \u00e9s qualsevol missatge, visual o textual, que acompanya un producte i comunica un <strong>benefici, funci\u00f3 o valor afegit<\/strong> relacionat amb el seu \u00fas, composici\u00f3 o impacte.<\/p>\n<p>Un claim pot ser:<\/p>\n<ul data-spread=\"false\">\n<li>\n<p><strong>Funcional<\/strong>: \u201chidrataci\u00f3 24 h\u201d, \u201creducci\u00f3 del colesterol\u201d, \u201cantibacteri\u00e0\u201d.<\/p>\n<\/li>\n<li>\n<p><strong>Sensorial o emocional<\/strong>: \u201ctextura lleugera\u201d, \u201csensaci\u00f3 de frescor\u201d.<\/p>\n<\/li>\n<li>\n<p><strong>\u00c8tic o mediambiental<\/strong>: \u201cveg\u00e0\u201d, \u201cbiodegradable\u201d, \u201crespectu\u00f3s amb l\u2019oce\u00e0\u201d.<\/p>\n<\/li>\n<li>\n<p><strong>Comparatiu<\/strong>: \u201cm\u00e9s efica\u00e7 que la versi\u00f3 anterior\u201d, \u201cmillor rendiment\u201d.<\/p>\n<\/li>\n<\/ul>\n<p>Per\u00f2 no tot s\u2019hi val. Per protegir el consumidor, existeixen normatives espec\u00edfiques per a cada sector.<\/p>\n<h3><strong>Cosm\u00e8tica: entre la creativitat i el reglament<\/strong><\/h3>\n<p>Des de 2013, els <em>claims cosm\u00e8tics<\/em> estan regulats a la UE pel <strong>Reglament (UE) N\u00fam. 655\/2013<\/strong>, que estableix <strong>6 criteris comuns<\/strong> que tota reivindicaci\u00f3 ha de complir:<\/p>\n<ol start=\"1\" data-spread=\"false\">\n<li>\n<p><strong>Conformitat legal<\/strong><\/p>\n<\/li>\n<li>\n<p><strong>Veracitat<\/strong><\/p>\n<\/li>\n<li>\n<p><strong>Evid\u00e8ncia comprovable<\/strong><\/p>\n<\/li>\n<li>\n<p><strong>Sinceritat<\/strong><\/p>\n<\/li>\n<li>\n<p><strong>Equitat<\/strong><\/p>\n<\/li>\n<li>\n<p><strong>Presa de decisions informada<\/strong><\/p>\n<\/li>\n<\/ol>\n<h3>\u274c Exemples de males pr\u00e0ctiques:<\/h3>\n<ul data-spread=\"false\">\n<li>\n<p><em>\u201cSense parabens\u201d<\/em>: tot i que aquests conservants estan permesos i regulats per la legislaci\u00f3 cosm\u00e8tica europea, el claim pot induir a error al consumidor i <strong>est\u00e0 desaconsellat<\/strong> per la Comissi\u00f3 Europea. Es considera <strong>denigrant<\/strong> cap a ingredients legals i segurs, i per tant, contrari als criteris del Reglament (UE) 655\/2013.<\/p>\n<\/li>\n<li>\n<p><em>\u201cNo testat en animals\u201d<\/em> (quan ja \u00e9s obligatori per llei no fer-ho a la UE).<\/p>\n<\/li>\n<li>\n<p><em>\u201cRejoveniment visible\u201d<\/em> sense estudis cl\u00ednics que ho recolzin.<\/p>\n<\/li>\n<\/ul>\n<p>Per justificar molts claims cosm\u00e8tics es requereix <strong>evid\u00e8ncia t\u00e8cnica<\/strong>, com assaigs cl\u00ednics, estudis d&#8217;efic\u00e0cia in vitro, proves d&#8217;usuari o tests sensorials.<\/p>\n<h3><strong>Alimentaci\u00f3: funcionalitat amb base cient\u00edfica<\/strong><\/h3>\n<p>Els <em>health claims<\/em> o reivindicacions de salut en productes alimentaris estan estrictament regulats pel <strong>Reglament (CE) 1924\/2006<\/strong>, que distingeix entre:<\/p>\n<ul data-spread=\"false\">\n<li>\n<p><strong>Claims nutricionals<\/strong>: \u201cric en fibra\u201d, \u201cbaix en sal\u201d.<\/p>\n<\/li>\n<li>\n<p><strong>Claims de salut<\/strong>: \u201ccontribueix al funcionament del sistema immunitari\u201d, \u201cajuda a mantenir nivells normals de colesterol\u201d.<\/p>\n<\/li>\n<\/ul>\n<p>Nom\u00e9s es poden utilitzar els claims <strong>aprovats per l\u2019EFSA<\/strong> (Autoritat Europea de Seguretat Aliment\u00e0ria), despr\u00e9s d\u2019un rigor\u00f3s proc\u00e9s de validaci\u00f3 cient\u00edfica.<\/p>\n<p>Exemple de claim aprovat:<br \/>\u2705 <em>\u201cEl zinc contribueix al funcionament normal del sistema immunitari.\u201d<\/em><\/p>\n<p>Exemple de claim rebutjat:<br \/>\u274c <em>\u201cL\u2019extracte d\u2019ar\u00e0ndano prev\u00e9 infeccions urin\u00e0ries.\u201d<\/em> (no es va acceptar per manca d\u2019evid\u00e8ncia robusta).<\/p>\n<p>Els aliments o suplements amb ingredients funcionals o nous han de comptar amb <strong>dossiers d\u2019evid\u00e8ncia<\/strong>, estudis cl\u00ednics, i complir amb el Reglament de Nous Aliments si escau.<\/p>\n<div contenteditable=\"false\">\n<hr \/>\n<\/div>\n<h3><strong>Detergents i neteja: efic\u00e0cia provada i sense exageracions<\/strong><\/h3>\n<p>El sector de deterg\u00e8ncia est\u00e0 regulat pel <strong>Reglament (CE) 648\/2004<\/strong>, i tot i que no hi ha un reglament espec\u00edfic de <em>claims<\/em>, s\u2019apliquen els principis generals de la legislaci\u00f3 sobre protecci\u00f3 de consumidors (Directiva 2005\/29\/CE sobre pr\u00e0ctiques comercials deslleials).<\/p>\n<p>A m\u00e9s, claims com:<\/p>\n<ul data-spread=\"false\">\n<li>\n<p>\u201cElimina el 99,9% de bacteris\u201d<\/p>\n<\/li>\n<li>\n<p>\u201cHipoal\u00b7lergogen\u201d<\/p>\n<\/li>\n<li>\n<p>\u201cSegur per a nadons\u201d<\/p>\n<\/li>\n<\/ul>\n<p>&#8230;
